Family of woman killed in 2004 Knoxville stabbing settles lawsuit

KNOXVILLE (WATE) -- The family of a slain ETSU graduate has settled a lawsuit against the Knoxville apartment complex where she was fatally stabbed in December 2004.

Michael and Joan Berry of Lawrenceville, Ga., had sued Brendon Park Apartments, Brendon Park Associates and First Management Services Inc. of Nashville for $3.1 million.

The Berrys claimed the apartment complex failed to provide adequate security for their  daughter, Johnia Berry, 21.

But the case, set for trial in February, has now been dropped.

The family's attorney, Mike Nassios, says terms of the settlement will not be released. The dismissal order was filed in Knox County Circuit Court on October 30.

In September 2007, a Knoxville man, Taylor Lee Olson, was arrested and charged with first degree murder in Berry's death.

However, Olson hanged himself in jail in March 2008 before he could be tried.
