NASHVILLE (WKRN) -- Kidnapped newborn Yair Carillo is no longer in state custody and will be returned to his mother after the Department of Children's Services withdrew a petition to keep the infant and his three siblings in foster care.
Thomas H. Miller, who was appointed guardian ad litem for the children, said Tuesday morning the reunion will take place as soon as possible.
Yair, who was just four-days-old when he was snatched from his home one week ago, was found safe Friday night in Ardmore, Alabama. That's about an hour and 20 minutes south of Nashville, just over the state line.
Saturday, after a brief moment with his mother, the child, along with his brothers and sisters, were placed in state custody for what a DCS spokesperson called "safety reasons."
Allegations surfaced Monday that the children were placed in foster care because a family member had tried to sell the infant.
The allegations turned out to be false and Nashville police said Tuesday, Yair's parents, Maria Gurrolla and Jose Carrillo, weren't involved in his kidnapping.
Police said the now 11-day-old boy should be returned to the custody of his parents, and a juvenile court hearing held Tuesday morning allows that to happen.
Kidnapping suspect Tammy Renee Silas, 39, remains in federal custody in Alabama.
Silas hasn't been charged in the attack on Gurrolla, who was stabbed several times before police said Silas stole the child.
