KNOXVILLE (WATE) -- A Knox County judge turned down a defense request Friday to delay the January murder trial of Raynella Dossett Leath.
Attorney Jim Bell asked for a delay in the trial that's scheduled to begin on January 11, 2010.
Bell said he need more time because of new counsel joining to help prepare the case, but the judge denied his request.
The January trial is for murder charges related to the shooting death of retired barber David Leath. He was shot in the head at their home on March 13, 2003.
Raynella Dossett Leath was tried once before on the same charges, but that case ended with a hung jury in March.
She is also accused of killing her first husband, former Knox County prosecutor Ed Dossett. The trial on those charges will go to court in August of next year.
Dossett's death was initially attributed to being trampled by cattle, prosecutors are hoping to prove in court he had been drugged with a lethal dose of morphine.
Last week, the Tennessee Court of Criminal Appeals rejected a request by prosecutors to disinter Dossett's body for a second autopsy.
