MORRISTOWN (WATE) - A contractor who specializes in fixing worn out driveways has left two East Tennessee customers with driveways that need plenty more work. 

The patching in the cracks on Doris Shelton's circular driveway at her Morristown home is crumbling. "You can actually take your finger and pull up some of those pieces," she said.

The driveway looks terrible. Not only is the patched concrete coming apart, but the contractor was supposed to make it one color and it's not.

Doris hired Rodney Miser in March and paid Miser Asphalt and Sealing more than $3,000. She wanted the driveway repaired before winter.

"The cracks were only small, relatively small lines," she said. "He came in with a machine and did some major drilling so now we have wide cracks."

Doris says Miser returned twice during the summer and sanded some of the fill, but never came back to repair the sloppy work. "We need to have the driveway corrected, the holes filled in."

In Bean Station it's a different story, but the results are similar for Jane and Tom Fraley. They also hired Miser to seal their driveway.

However, it wasn't a good fix. The sealant has disappeared in spots.

"That's the original asphalt," Tom said. "The dark area is where he resealed it. All this spotty stuff is where the original asphalt is showing through."

The tar-like coating wore out long ago and in some areas, the driveway is coming apart. "You can see where the asphalt is crumbling away from there because there is no sealer," Jane said.

The couple paid $1,500 for the sealer three years ago. They had a two-year warranty, but they say it was never honored.

"We've been expecting him to come back and fix it like he said he would," Tom said.

6 On Your Side reached Miser two weeks ago when he said he was working in Georgia. We asked him about the Fraley's driveway.

"I know there is a problem over there and I need to fix it," he said. "I just slid it to the back. I'm not lying. That's what I've done."

Miser blamed the filler he used for the problems with Doris' driveway. "Sherwin Williams sold us a bad product. They said lots of people have had trouble with the crack sealer that they used."

But Doris recently checked with Sherwin Williams and so did 6 On Your Side. The company knows of no crack sealer that caused any contractor trouble like she had.

Rodney Miser said nearly two weeks ago he would call both families. He never has. Neither one wants him to come back anyway.

Doris is looking for a new contractor to fix the mess left behind by Miser Asphalt.
