Ruling allows new prosecutors if convicted Knoxville rapist gets new trial

KNOXVILLE (WATE) - A Knox County judge granted a motion Friday for new prosecutors if a convicted rapist receives a new trial.

Jayson Bailey was convicted in April 2010 on four counts of rape of a child. Ex-Judge Richard Baumgartner sentenced Bailey to 38 years in jail.

Bailey was in court Friday morning for a motions hearing. His attorney, Greg Isaacs, claims Baumgartner's addiction to prescription pills prevented Bailey from getting a fair trial.

Baumgartner pleaded guilty in March 2011 to official misconduct and resigned from the bench.

"We're continuing to see fallout from the Baumgartner issues and I think this ruling will help expedite my case and maybe some others," Isaacs said after the ruling.

Judge Jon Kerry Blackwood will hear Bailey's motion for a new trial.

If that's granted, Judge Mary Beth Leibowitz will preside over the case. The new prosecution team will be from outside Knox County.
