MARYVILLE (WATE) - The Blount County Grand Jury decided not to indict a Louisville man on charges in a 2010 house fire that claimed the life of his estranged girlfriend.

Thomas David Henderson was originally charged with homicide and aggravated arson.

He was arrested in October 2010 after deputies responded to a report of a domestic disturbance and a house fire on Fox Creed Road in Louisville.

When deputies arrived, Henderson was standing in front of the burning home. He told deputies that Cheryl Quinn, 56, was inside. She was found unconscious and later died after she was transferred to Vanderbilt Burn Center.

In a March 2011 court hearing, prosecutors used a 911 recording from the night of the fire with Quinn saying Henderson had set it.

However, Henderson's attorney, Bryan Delius, had witnesses from an April 2010 incident at UT Medical Center he said proved Quinn threatened to burn Henderson's possessions.

Quinn was at the hospital after being injured in a motorcycle wreck. Two nurses heard Quinn come in and make the threat.

The grand jury returned a no true bill for Henderson on Monday.

Delius says he'll for the arrest to be expunged from Henderson's record.
