KNOXVILLE (WATE) - Knox County prosecutors are appealing another retrial stemming from the downfall of ex-Judge Richard Baumgartner.
Jayson Bailey was originally convicted in 2010 on four counts of rape of a child and sentenced by Baumgartner to 38 years in jail.
But in March 2011, Baumgartner resigned from the bench and pleaded guilty to official misconduct. He's also facing seven federal counts of misprision of a felony.
Judge Jon Kerry Blackwood ordered a new trial for Bailey in April.
The judge is expected to issue a written ruling on the appeal next week.
