Judge denies defense motions in case against ex-Knox County Judge Baumgartner

KNOXVILLE (WATE) - A federal judge on Thursday shot down two requests from defense attorneys representing Ex-Knox County Judge Richard Baumgartner.

U.S. Magistrate Judge Clifford Shirley issued his decisions in a memorandum and a report.

The defense team wanted information from a GPS tracker, pictures of Baumgartner's car and medical records suppressed as unconstitutional. That's despite prosecutors saying they did not plan to use those items in the main part of the case.

Judge Shirley rejected the motion to suppress, saying the evidence could be used but only to refute testimony if Baumgartner takes the stand.

The judge also ruled that the prosecution did not have to provide defense attorneys with a bill of particulars, laying out its case against Baumgartner.

He's accused of concealing and not reporting felonies in his dealings with Deena Castleman, a woman he became involved with and shared prescription pills with, according to a probe by the Tennessee Bureau of Investigation.
