NASHVILLE (AP) - The Tennessee Supreme Court has ruled in favor of a mining company in its bid to continue work in Jefferson County.
The county issued a stop work order in 1998 after enacting a comprehensive zoning ordinance that limited the land to agricultural use.
The American Limestone Company, Inc., and subsequent owner Ready Mix, USA, fought the order. They claimed that a grandfather clause allowed businesses that were in operation at the time of the zoning change to continue.
On Thursday, the state Supreme Court ruled unanimously in favor of Ready Mix. Although mining operations had been inactive for years before the zoning change, the court found the company had taken sufficient action in the month leading up to the change to establish that the business was once again in operation.
