Knoxville officer cleared in July shooting incident

KNOXVILLE (WATE) - A Knoxville Police Department officer has been cleared in a July shooting.

Following an investigation, officials determined that Officer Brian Leatherwood acted appropriately to save his life as well as the life of the suspect's mother. 

Leatherwood shot 47-year-old Paul Capps after responding to a call at the home of Capps' mother. The woman told dispatchers her son was assaulting her.

After arriving on the scene, Leatherwood said Capps stole his flashlight and began beating him. When the officer's taser was ineffective at subduing him, he said he had no choice but to shoot the man.

"The department continues to keep the Capps' family in our thoughts and prayers over this tragic event," the department said in a news release Friday.

Officer Leatherwood has returned to full duty.
