KNOXVILLE (WATE) - Deliberations continued into a second day Wednesday as the jury continued to weigh their decision in the case against former Judge Richard Baumgartner.
As the jury continued to pore over evidence, they are tasked with deciding if the government proved four elements beyond a reasonable doubt:
1) Deena Castleman committed the federal felony of conspiracy to distribute controlled substances;
2) The defendant had full knowledge of that fact;
3) The defendant failed to notify authorities that the crime had been committed.
4) The defendant knowingly took an affirmative step to conceal Deena Castleman's commission of the federal felony of conspiracy to distribute controlled substances.
Baumgartner faces 6 counts of misprision of a felony.
U.S. District Judge Ronnie Greer said the jury will consider each charge separately.
For a guilty or not guilty verdict the entire jury must agree.
Baumgartner pleaded guilty in March 2011 to official misconduct and resigned from the bench.
His trial in federal court stems from his arrest in May 2012 on an indictment that he attempted to cover up drug buys.
