Man faces attempted murder charge after shootout with state trooper


JONESBOROUGH (AP) - Charges against a man arrested after a gunfight with a Tennessee state trooper have been bound over to a grand jury.

The Johnson City Press reported some charges against 20-year-old Derrick Dakota Kitzmiller were dropped, but his case was sent to a Washington County grand jury on a number of violations that include attempted second-degree murder and being a felon with a handgun.

The gunfire came after a high-speed chase and shootout early Jan. 3.

Trooper Jeff Appleba testified at a hearing Tuesday, saying he heard a popping sound coming from Kitzmiller's car after it wrecked and realized it was gunfire.

Appleba returned fire, keeping Kitzmiller pinned down until backup arrived.

A THP investigator testified Kitzmiller said he blacked out right after the crash and remembered nothing else.
