Cobbins appeals decision to deny new trial

KNOXVILLE (WATE) - Christian-Newsom murder defendant Letalvis Cobbins is taking his case to the state's court of appeals.

Cobbins was convicted in August of 2009 and sentenced to life in prison.

He was initially granted a retrial after original Judge Richard Baumgartner admitted his addiction to prescription painkillers.

Special Judge Walter Kurtz then denied that retrial last month.

Fellow defendant LeMaricus Davidson, who was also denied a retrial, has filed for appeal.

Thomas's case could go back to trial in May. A hearing is set for later this month.
