Group suing TVA over tree-cutting policy suffers setback

KNOXVILLE (WATE) - A federal judge dealt a blow to the lawsuit aimed at stopping TVA's new tree-cutting policy.

Judge Tom Varlan dismissed three of the seven counts in the lawsuit against TVA.

Homeowners from Knox County and other communities sued to stop TVA from cutting down trees in the vicinity of their power lines.

The judge ruled that a 1937 property easement gave the utility power to make that move.

Judge Varlan did leave open part of the case allowing other plaintiffs to join.
