Judge signs order allowing Smoot to leave state


KINGSTON (WATE) - The man facing murder charges in the death of his ex-girlfriend who was released on bond Tuesday has left the state.

Shawn Smoot was released from jail on Tuesday after posting a $250,000 bond.

Smoot is the main suspect in the death of his ex-girlfriend, Brooke Nicole Morris, whose body was found by a Roane County road in October of 2011. She had been shot to death.

One of the conditions of his release was that he remain in Tennessee until his June court date.

On Thursday, 6 News learned that Smoot had left the state with permission from a local judge.

But District Attorney General Russell Johnson said he was not aware of the plans until after Smoot had already left the state.

"The judge signed an order without the knowledge of our office and without any opportunity for argument, allowing him to go to Mississippi to pick up his belongings," Johnson told 6 News on Thursday. "He is due back tomorrow, according to the probation officer that is monitoring him."
