KINGSTON (WATE) – A former Knoxville insurance agent accused of killing a Roane County woman was given a new attorney Monday to represent him.

Shawn Smoot is accused of first degree murder in the 2011 death of his former girlfriend, Brooke Morris.

Smoot was not in court Monday when his attorney, Walter Johnson, filed a motion to no longer represent him.

Howard Vogel, a Knoxville-based attorney will now represent Smoot.

Johnson asked to be removed from the case because a conflict of interest surfaced after a statement recently filed by a witness turned out to be someone Johnson had previously represented.

Smoot's trial is not likely to take place until next year.

He became a suspect in Morris's death shortly after she was found dead of a gunshot wound on a Roane County road.

He was indicted on murder charges by a Roane County grand jury in July 2012, but failed to turn himself in as ordered.

Smoot was later captured in Mississippi.
