NEWPORT (WATE) – A witness to a Cocke County crash is coming forward to defend the family in the car.

A report from Tennessee Highway Patrol said the three year old killed in the accident was not in a car seat. It also says his five year old brother, now on life support, was not restrained either. The crash happened on Wednesday on Highway 25 E in Newport in Cocke County.

Now, Atorius Cody, 3, is dead. Skyler Cody, 5, is on life support. Their mother Twanna Cody lost the baby she'd been carrying for nine months, according to family members. Twanna's boyfriend Brandon was behind the wheel. It was an accident scene Jamie Carver just happened to drive upon.

"I wish I had gotten there sooner. I wish I had known the boys were in there sooner. I wish there was more that I could have done," Carver said.

He says the family was calling for help.

"I stuck my head in the car and saw two little boys in the car. I realized Skyler was in a booster seat. I got my pocket knife out and cut the seatbelt and handed him to my niece," he said.

Next Jamie went in for Atorius.

"I unbuckled him, moved the strap and was pushing him back. I noticed his lips and face were blue," Carver said.

Carver says after hearing the news that the THP report said the boys were not restrained, he felt the need to come forward.

"They were strapped in correctly," Carver said.
