KNOXVILLE (WATE) – A teacher's assistant at Fulton High School was arrested Monday for allegedly assaulting a student.

Gary Hamilton, 48, the In-School Suspension (ISS) instructional assistant was charged with simple assault after an altercation with freshman Montel Castle, 14.

"He got in my face and started beating me up," Montel Castle explained.

Castle says it all started because of a pair of blue jeans.

"They said I couldn't wear these pants because they've got scratches in them," he said, showing off his jeans he says he's worn multiple times.

Castle was sent to ISS for violating the dress code.

When he got there he realized he needed to go back to his classroom for his homework.

"I went back to get my work and left my hall pass," he said. "When I got back [Mr. Hamilton] was angry for forgetting the pass. He thought I was disrupting his class, he sent me out, he said ‘listen here boy' and got in my face. Next thing I know, he pushed me against the wall and punched me in my face three times. He said 'you think you tough now?' He slammed me against the floor so I couldn't do anything," Castle explained.

The school security officer arrested Hamilton at the school, and he was picked up by the Knoxville Police Department.

Castle's mom rushed to the school when she got the call from her son.

"When I got there he was all shook up with this big old bag of ice on his face," said Kim Castle, Montel's mother.

The ice was for the bruises that are slowly starting to show on his face. But he also has bruises on his back, chest and shoulders.

They went to the hospital to have him checked out.

"My head was hurting really bad from where he pushed my head against the wall," Montel said.
Castle's mom says she can't believe something like this could be allowed to happen.

"You expect maybe a call about a kid being in a fight but for another adult to put their hands on your kid, I was fearful," Kim Castle said in disbelief.

Montel Castle says today was the first time he's ever met Gary Hamilton, in fact it's the first time he's been in ISS in high school.

Knox County Schools spokesperson Melissa Ogden said Hamilton has been placed on administrative leave with pay, pending completion of the investigation. Hamilton has been with Knox County Schools since March 2012 and an employee at Fulton High School since last fall.

Castle says she doesn't want him anywhere near her son again.

"I don't want him to be at that school again. If it happened to my child, it might happen to someone else's," she said. "I never thought I'd have to go to school and look at my son being treated like that, that's one place you want your kids to feel safe."
