GREENEVILLE (WATE) - A Greene County jury was given the domestic assault case of state Rep. David Hawk Wednesday, but without one of the charges against him.

The lawmaker is charged with reckless endangerment count following an altercation in March 2012 between Hawk and his former wife, Crystal Goan.

Judge Paul Summers agreed on Monday to dismiss an aggravated assault charge filed against Hawk. The judge said prosecutors failed to prove Goan suffered serious bodily injuries.

Hawk has maintained he is innocent.

He represents District 5 in the state legislature, a district that includes Unicoi County and part of Greene County.
