POWELL (WATE) - A 90-year-old Powell woman who was ripped off by a roofing company is going after them in court.

As 6 On Your Side explained a few weeks ago, the roofer got nearly $9,000 but no work has been done.

Barry Rummell and his 90-year-old mother-in-law Gladys, who asked for her last name to not be revealed, had expected to hear something from Tyler Hirsch of Hirsch Enterprises, formerly of Knoxville.

Hirsch Enterprises collected over $8,600 in two checks to replace Gladys' roof. The job was to begin August 1. The work never started.

"We hired an attorney to go after the guys that took the money," said Rummell.

"I have never been down this road before so it's all new," added Gladys.

In their lawsuit, Gladys and her son-in-law claim the roofing company breached its contract, which Gladys signed in June. The contract claimed the roof would be finished in weeks.

"We'd just like to have our money back and get things straightened out. They took an awful lot of money and didn't do nothing," said Rummell.

Last month, 6 On Your Side went to an office building in West Knoxville looking for Tyler Hirsch, but the office manager said Hirsch Enterprises moved out in mid-August.

"If he's done it to me, he's done it to others," Gladys said.

"It was supposed to be Hirsch Enterprises doing work for Pinnacle Home Improvements; it didn't turn out that way," said Rummell.

The contract shows Hirsch had been using the good name of Pinnacle Home Improvements, apparently illegally.

Last month, 6 On Your Side talked with the owner of Pinnacle Home Improvements, Jim Marino.

A memo sent from Marino to Tyler Hirsch in late May says for use of Pinnacle's trademark, Hirsch was required to clearly tell customers that their contract was through Hirsch Enterprises, LLC.

Doing business as Pinnacle Home Improvements and failure to do provide this information are grounds for revoking the license. 

"We're going after Pinnacle, Tyler Hirsch and Steve Hinton," said Rummell, speaking about his lawsuit.

The name Steve Hinton was endorsed on one of the checks from Gladys to the roofing company, Hinton was the local company manager.

6 On Your Side has made numerous attempts to reach Hirsch, who is also a licensed realtor, but he has not responded.

"I want my money so I can get my roof on. The rest is up to the law or whoever will take care of him," said Gladys.

The attorney representing Gladys tells 6 On Your Side that following the spring storms of 2011, several out-of-area or out-of-state roofing companies opened offices in East Tennessee, found plenty of roofs to fix, but disappeared within a year or two.

6 On Your Side has exposed some of these companies, but few of them have been served with a lawsuit claiming breach of contract and various violations of the Tennessee Consumer Protection Act.
