State says it has located 'missing' evidence in 2005 Campbell Co. school shooting case

JACKSBORO (WATE) - District Attorney Lori Phillips-Jones says key evidence in the deadly 2005 shooting at Campbell County High School once believed missing has now been located and was never missing to begin with.

Suspect Kenny Bartley's attorney Greg Isaacs filed a motion saying he discovered on January 21 that key videotaped interviews with victims Gary Seale and Jim Pierce were lost and/or destroyed and were never transcribed.

Phillips-Jones told 6 News Monday afternoon the evidence has been located.

"There was never any lost evidence. We were in the process of trying to locate these video tapes ever since the motion was filed. We have located them, and have submitted them as a supplemental discovery today," she said.

Isaacs issued a statement shortly thereafter:

"After filing our motion to dismiss, I was informed today that the state has 'located' the video statements. Shortly thereafter they were delivered to our law firm. We appreciate the state's professionalism in locating this important evidence that had never been previously provided to our firm."

Bartley's videotaped interview and the transcription thereof were always part of the court record.

Isaacs had asked for the case to be dismissed saying without the interviews with Seale and Pierce, it's unfair to move on with the trial. Isaacs also asked for Bartley's videotaped interview to be thrown out as well.

Attorneys are still asking to throw out some newly discovered evidence saying Isaacs' office has not had time to review the evidence.

Bartley is accused of shooting three administrators at Campbell County High School in November 2005 with a .22-calibre handgun.

Assistant Principal Ken Bruce was killed. Principal Gary Seale and Assistant Principal Jim Pierce were wounded.

Bartley pleaded guilty to the shootings in a plea deal, but was granted a new trial in June 2011.

The jury will be selected from Hamilton County on February 21 with the trial to start in Campbell County the next day.
