Mistrial declared in Rocky Houston case

KNOXVILLE (WATE) - A mistrial was declared Wednesday in the case of Rocky Houston, who was scheduled to go on trial for federal gun charges.

The U.S. Attorney's Office says Houston's lawyer informed the judge that he failed to strike one of the jurors that Houston objected to during Tuesday's jury selection.

As a result, the judge declared a mistrial.

A new trial date is set for March 17.

Houston was arrested in January 2013 for owning out-of-state guns as a felon. His brother Leon was arrested on federal gun charges as well.

A federal court jury found Leon Houston not guilty in November 2013.

The two brothers were charged and tried, but never convicted of first degree murder of a deputy and former police officer in 2006.
