KNOXVILLE (WATE) - High profile Knoxville attorney Bruce Poston was in court Thursday to be arraigned on drug charges.

Poston was arrested on April 15 after he was indicted on three drug charges and two counts of violation of the driver's license law.

During the arraignment, Poston waived the formal reading of the charges against him.

His trial has been set for October 28.

According to Poston's attorney Mike Whalen, Poston's license was suspended for failing to pay a speeding ticket in a county outside of Knox. Whalen says the speeding ticket has now been resolved.

According to the indictment, on Jan. 23 and Feb. 4, Poston delivered hydrocodone. Later on on Feb. 4, he attempted to deliver hydrocodone, all the while driving on a suspended license.

The investigation started after a woman told the Tennessee Bureau of Investigation Poston was giving her pills and money and that they were having sex. She said Poston was her husband's attorney and that the case was mishandled to further the sexual relationship. According to the TBI, an undercover operation corroborated her claims.

Each Knox County criminal court judge have recused themselves from this case, saying there would be a conflict with a judge from Knox County hearing the case. Senior Judge Jon Kerry Blackwood has been appointed.

Poston's attorney has filed a motion of discovery asking for evidence related to the case. A motions hearing date was not set Thursday. The attorneys said they may communicate and try to schedule a hearing at a later date.

Retired Sullivan County District Attorney General Greeley Wells has been assigned to the case.
