SUNBRIGHT (WATE) - The criminal case against a former Sunbright Elementary School principal accused of abusing a 5-year-old boy by paddling him has been dismissed after she made a public apology to the family.

Dr. Penny Boyd was removed as principal of Sunbright School after padding a child in August 2012. The child's mother said the paddling left bruises all over his buttocks.

Assistant District Attorney Frank Harvey says he called the family as the case was coming up for trial. The boy's mother said the civil litigation had been resolved and she just wanted a public apology.

Boyd submitted an apology in writing, which is now part of the court record, and paid half of the court costs.

The charges were then dismissed.

Harvey says all parties involved are glad the case is resolved.
