Driver from fatal Strawberry Plains crash charged with 2nd DUI

The driver from a deadly Strawberry Plains crashed that killed a 2-year-old has been charged with his second DUI offense.

Joevon Deltroy Foust, 26, has been charged with his second ever DUI and reckless driving after police say he lost control of his car on I-40 W and ran off the road, killing 2-year-old Zyliya Irvin of Knoxville.

Zyliya Irvin was in a child restraint in the back seat, but it was not properly fastened to the car and she, as well as the two adults, were ejected from the Pontiac, police said. 

According to court documents, Foust and Jasmine Irvin, the other passenger in the vehicle, admitted to drinking.

Foust’s first DUI offense came in 2016 when he was pulled over driving westbound on Magnolia Avenue at Hall of Fame Drive. He was also charged with driving on a suspended license. 

He also has previous convictions including shoplifting and manufacturing, delivery, sale or possession of a controlled substance.
